DMCA Copyright Infringement Policy

Lease Local respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we have adopted the following policy concerning copyright infringement for our website, LeaseLocal.com (the "Site").

1. Designated Copyright Agent

2. Reporting Copyright Infringement (Takedown Request)

If you are a copyright owner or an agent thereof and you believe that any content on the Lease Local website infringes your copyright, you may submit a DMCA takedown notice by providing the following information in writing to our Designated Copyright Agent:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the infringing material and information reasonably sufficient to permit Lease Local to locate the material on the Site (e.g., the specific URL(s) of the infringing content).
  • Information reasonably sufficient to permit Lease Local to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your takedown notice may not be effective.

Please be aware that if you knowingly materially misrepresent that material or activity on the Site is infringing your copyright, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

3. Takedown Procedure

Upon receipt of a valid and complete DMCA notice, Lease Local will:

  • Expeditiously remove or disable access to the material claimed to be infringing.
  • Notify the user who provided the allegedly infringing content of the takedown.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and, if available, email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the U.S., for any judicial district in which Lease Local may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Lease Local may reinstate the removed material in 10–14 business days unless the copyright owner files a court action seeking a court order to restrain you from engaging in infringing activity relating to the material on the Site.

Please be aware that if you knowingly materially misrepresent that material or activity on the Site was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

5. Repeat Infringer Policy

Lease Local reserves the right to terminate the accounts of users who are repeat copyright infringers.

6. Notice

UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY AND CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS FEES.
